Terms Of Service
1. Services Provided
Capital Growth AI provides AI-powered automation services, including but not limited to:
AI voice assistants
AI chatbots
Call handling and routing systems
Appointment booking systems
CRM integrations
Workflow automations
Lead capture systems
Custom AI training and deployment
Services are customized for each Client based on the agreed onboarding and implementation scope.
2.Setup Fee and Implementation Period
A one-time, non-refundable setup fee of $500 is required before any work or onboarding begins.
Upon payment of the setup fee, Client will receive access to a 14-day Implementation Period. This period is intended to allow Client time to schedule the implementation meeting, complete onboarding requirements, and begin setup of services.
It is the Client’s responsibility to schedule the implementation meeting during the 14-day Implementation Period using the scheduling information provided after checkout.
Failure by Client to schedule or participate in onboarding during the Implementation Period does not relieve Client of subscription obligations or entitle Client to refunds.
The setup fee includes:
Custom system configuration
AI assistant setup and training
Initial integrations
Workflow deployment
Testing and onboarding
3.Subscription Plans
Client agrees to subscribe to one of the following recurring monthly plans:
Starter Plan
$99 per month
Includes 300 minutes per billing cycle
Additional usage billed at $0.25 per minute
Growth Plan
$147 per month
Includes 500 minutes per billing cycle
Additional usage billed at $0.25 per minute
Pro Plan
$297 per month
Includes 1,000 minutes per billing cycle
Additional usage billed at $0.22 per minute
Monthly subscription fees are billed automatically to the payment method on file.
Unused minutes do not roll over into future billing periods.
4.Usage Billing and Wallet Recharge
Usage is tracked based on total system usage and call minutes during each billing cycle.
Any usage exceeding included plan minutes will be billed automatically to the payment method on file as charges are incurred unless Client has enabled automatic wallet recharging.
Clients may choose to use an automatic recharge wallet system for overage billing.
If enabled, wallet balances will automatically recharge once the balance reaches zero.
The minimum automatic recharge amount is $10.
Automatic wallet recharge settings cannot be disabled while services remain active.
If Client wishes to stop usage beyond included plan limits, Client must directly request suspension or pausing of services through approved communication channels.
Unless Client specifically requests suspension of services, usage charges and overage billing will continue automatically.
Client acknowledges and agrees that Company is not responsible for charges incurred due to continued active usage when suspension has not been requested.
5.Payment Authorization
By submitting payment information, Client authorizes Capital Growth AI to automatically charge the payment method on file for:
Setup fees
Recurring subscription fees
Usage overage charges
Automatic wallet recharge charges
Any approved service-related charges
A valid payment method must remain on file at all times while services are active.
Failed, declined, disputed, or reversed payments may result in immediate suspension or termination of services.
Client agrees to contact Company to resolve billing concerns before initiating chargebacks or payment disputes.
Payments are processed using Authorize.net and other third-party payment providers as necessary.
6.Optimization Period and Revisions
Client will receive a 30-day Optimization Period beginning upon the earlier of:
Implementation of services
The start of recurring subscription billing
During this Optimization Period, Client may request reasonable adjustments to AI responses, workflows, scripts, and automations at no additional charge.
After the 30-day Optimization Period ends, additional changes, revisions, rebuilds, or modification requests will be billed at a minimum of $300 per request depending on scope.
7.Client Responsibilities
Client agrees to:
Provide accurate business information
Participate in onboarding and implementation
Review AI outputs and automations for accuracy
Use services in compliance with applicable laws and regulations
Maintain proper communication regarding requested pauses or service changes
Client understands that AI-generated responses and automations may occasionally contain inaccuracies and Client remains responsible for reviewing business-critical communications and compliance obligations.
8.Third-Party Services
Services may rely on third-party platforms including but not limited to:
Twilio
Authorize.net
GoHighLevel
OpenAI
Other communication, hosting, or automation providers
Capital Growth AI is not responsible for outages, downtime, pricing changes, API limitations, service interruptions, or failures caused by third-party providers.
9.Intellectual Property and Ownership
Capital Growth AI retains ownership of all proprietary systems, workflows, prompts, automations, configurations, scripts, training methods, backend structures, and deployment architecture created by Company unless otherwise agreed in writing.
Client is granted a limited, non-transferable, revocable right to use deployed systems during active paid service.
Company reserves the right to suspend, restrict, disable, or remove access to services in cases of non-payment, payment disputes, abuse, or violation of this Agreement.
10.Disclaimer of Warranties
Services are provided on an “as is” and “as available” basis.
Capital Growth AI makes no guarantees regarding uninterrupted availability, error-free operation, lead generation results, revenue increases, business performance, or specific outcomes from use of services.
11.Limitation of Liability
To the maximum extent permitted by law, Capital Growth AI shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from use of services.
Company’s total liability under this Agreement shall not exceed the total amount paid by Client to Company during the previous three months of active service.
12.Cancellation and Termination
Client may cancel services at any time prior to the next billing cycle.
No refunds will be issued for:
Setup fees
Partial billing periods
Unused minutes
Completed work
Cancellation requests must be submitted before the next billing date to avoid future charges.
Company reserves the right to suspend or terminate services for non-payment, abuse, fraudulent activity, excessive chargebacks, or violation of this Agreement.
13.Governing Law
This Agreement shall be governed and interpreted under the laws of the State of Florida.
14.Modifications to Agreement
Capital Growth AI reserves the right to update or modify this Agreement at any time.
Continued use of services following updates constitutes acceptance of the revised terms.
15.Electronic Acceptance
By checking the box indicating acceptance of these Terms of Service, submitting payment, or using Company services, Client acknowledges that they have read, understood, and agreed to this Agreement in full.
Electronic acceptance shall be considered legally binding and equivalent to a handwritten signature.
